    I John Martin, Sr. of the county of DeKalb and State of Tennessee do make and publish This my last Will and Testament hereby revoking and making void all former Wills by me at any time heretofore made knowing the uncertainity of life and the certainity of death.
    First I give my boddy to the dust and my soul to God who gave it to me. And to sutch worldly estate as it hath pleased God to intrust me with, I dispose of the same as follows;
    First Direct all my debts and funeral expences be paid as soon after my decease as possible out of my moneys I may die possessed of or may first come into the hands of my executors from any portion of my Estate Real or personal.

    Secondly I give to Elizabeth Cantrell and her children three negroes namely Rachel Francis and Martin all three rated at Sixteen hundred dollars.

    Thirdly I give to Robert Martin three Negroes namely Jane Rhoda and George all three rated at sixteen hundred dollars.

    Fourthly I give to William C. Martin three Negroes namely Alvin Martha and Jack all three rated at fifteen hundred and fifty dollars.

    Fifthly I give to John Martin and his children three negroes namely Betty Ruth and Joseph all three rated at fifteen hundred dollars.

    Sixthly I give to Sampson Martin's children three negroes namely Bill Henry and Salina and a certain piece of land where they now live. The said Negroes and land all rated at sixteen hundred dollars.

    Seventhly I give to Tilletha Walker and her children three Negroes and a stud colt -- it being three hundred dollars more than she ought to have in Justice.

    Eighthly I give to James Martin three Negroes namely Letty Dick and Joyett and the tract of land where on he now lives all rated at sixteen hundred dollars.

    Ninethly I give to Thomas Martin three Negroes namely Mary Sarah and Nancy all three rated at eleven hundred dollars also to Thomas our Stable hosso? our Waggon and two Steers worth one hundred and eighty dollars and all the land inside of hi s fence he payed two dollars per acre that is all over two acres.

    And here I will State that having Given all my sons a piece of land Except John Therefore I will to him one hundred dollars in place thereof .

    Tenthly My will is that after my decease the lands whereon I now live at Skirt Mountain and a tract on Banard Creek be sold on a twelve months credit and that thereof my children whose shares are the less shall be made equal to those of the gr eat is with the intent of this money which they were behind and thus my will is that my wife Sally shall have sufficient of the cleared land to maintain her, her lifetime, together with the dwelling house Kitchen and furniture thereof which is he r own concerning which furniture she may dispose of as she will at her death-----and then my wife is to have my saddlehouse and a farm horse and farming tools and Silver my Negro man and Dorcas my Negro woman so long as she remains my widow.

    Concerning the sale of my lands; if after all my children are made equal there should be a remainder it shall be equally divided among all my children.

    Lastly I do hereby make ordain and appoint my beloved Sons John Martin James Martin together with my wife Sally my executors of this my last Will and Testament in witness whereof I John Martin the said Testator have this my Will written on on e sheet of paper set my hand and seal this 9th day of January 1854.

    The said Lillie Scott is to own and posses said house and lot so long as she wishes but should she find that she can better her condition by selling it and buy elsewhere, she can do so but the house she is in possession of at her death is to be inherited by her bodily heirs.

    Should she survive all her bodily heirs and have none living at her death, then her whole possessions are to be equally divided between her brothers and sisters.
